Axite B.V. Terms and Conditions for Brain Activity Monitoring

1. Introduction

Welcome to Axite B.V. (“Axite”, “we”, “us”). By using our brain activity monitoring service (“Service”), you agree to these Terms and Conditions (“Terms”). These Terms describe what you can expect from us, what we expect from you, and how we handle your data responsibly. If you do not agree with these Terms, please do not use the Service.

2. Description of the Service

Our Service allows you to monitor your brain activity using EEG sensors, together with optional smartphone and wearable data, to gain insight into your mental and cognitive states in everyday life. The Service provides informational and wellness insights only. It is not a medical device and should not be used as medical advice. Always consult a qualified professional for health concerns.

3. Eligibility and Age Requirements

You must be at least 16 years old to use the Service. If you are under 16, you may use the Service only with verified parental or guardian consent. We do not knowingly collect or store personal data from anyone under 16 years of age.

4. Data Collection and Processing

When you use the Service, you consent to us collecting and processing EEG, smartphone, wearable, technical, and account data. Data is encrypted during transmission and at rest, stored securely in EU-based Supabase servers (EU-West), and accessible only by authorised Axite developers. Data uploads typically occur over Wi-Fi unless you change this in settings.

5. Consent to Data Use

By accepting these Terms and using the Service, you consent to Axite collecting and processing your EEG, smartphone, and wearable data for the purposes described to provide personalised insights, improve the Service, and support anonymised analytics.

The Service is for informational and entertainment purposes only and does not process data for medical diagnosis or treatment. You can withdraw consent and request deletion at any time (see Section 11).

6. Data Ownership and Use

You own your EEG and physiological data. You grant Axite a worldwide, royalty-free licence to process your data and display them to you to provide the Service. We do not sell personal data. We may use anonymised data for research, development, and analytics. Participation in research studies is optional and requires separate consent.

7. Your Responsibilities

You agree to use the Service only for lawful, personal purposes; provide accurate information; keep your credentials secure; and follow any usage instructions. You must not reverse engineer, copy, or redistribute the software.

8. Privacy and Your Rights under GDPR

You have the right to access, correct, delete, restrict, or object to processing of your data, and to withdraw consent at any time. Requests can be sent to info@axitetech.com. We use encryption, pseudonymisation, and strict access controls to protect your data and will notify you of any breach if required by law.

9. Risks and Limitations

Using EEG devices may cause mild discomfort or skin irritation. Data recordings may be incomplete or inaccurate. The Service is for reflection only and should not be used for medical purposes.

10. Liability Disclaimer

The Service is provided 'as is' and 'as available'. Axite disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for indirect or consequential damages. Our liability is limited to the amount you paid for the Service (if any) in the preceding 12 months.

11. Cancellation, Cooling-Off and Data Deletion

If Axite offers paid plans, you may cancel within 14 days. If you start immediately, you may waive this right by confirming it during signup. You may stop using the Service anytime by uninstalling the app or contacting info@axitetech.com. We retain data while your account is active. Upon request, we will delete or anonymise personal data as soon as practicable and respond within one month under GDPR Article 12(3).

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. Any disputes will be handled by the courts of the Netherlands, unless mandatory local laws apply.

13. Miscellaneous

If any provision of these Terms is invalid, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Axite. Our failure to enforce any right is not a waiver of that right.
